Terms of sale

Version of 10/13/2026.

1. The seller

Visual Engine is published and sold by Moustadrane BACO, sole proprietor (French micro-entreprise), trading as Mayana DEV, SIRET 131 397 218 00010, 13 rue du Bon Calalou, 97200 Fort-de-France, Martinique, France.

2. Purpose

These terms apply to every purchase of a Visual Engine license made on this site by a private individual. The buyer accepts them by ticking the box provided before paying. The applicable terms are those online at the time of the order.

3. The product

Visual Engine is software for the X-Plane 12 flight simulator: a plugin and its app. It is digital content supplied without a physical medium: the buyer receives a license key and downloads the software from this site.

Visual Engine is entertainment software: it must not be used for real-world flight training or navigation.

4. Price

The price is the one shown on the purchase page at the time of the order, in euros, all taxes included. There are no delivery charges. The seller may change the price at any time; the price paid is the one shown when the order was placed.

5. Order and payment

A purchase requires an account on this site with a confirmed email address. Payment is made in full, online, through Stripe: the seller neither receives nor stores card numbers. The order is concluded when the payment is confirmed; the buyer then receives a confirmation email.

6. Supply

As soon as the payment is confirmed, the license key is created, linked to the buyer's account and sent to the buyer's email address, usually within a minute and at the latest within 24 hours. If it does not arrive, the buyer writes to the seller.

7. Right of withdrawal

For a distance purchase, a consumer normally has 14 days to withdraw (article L. 221-18 of the French Consumer Code). This right cannot be exercised for digital content supplied without a physical medium whose performance has begun before the end of that period, where the consumer has given express consent and acknowledged losing the right of withdrawal (article L. 221-28, 13° of the same code).

Visual Engine is supplied immediately. Before paying, the buyer therefore ticks a separate box, expressly requesting this immediate supply and acknowledging the loss of the right of withdrawal once the supply has begun. This agreement is confirmed in the email that carries the key. Without this box, the order cannot be placed.

The seller remains free to grant a refund as a goodwill gesture. Any full refund deactivates the license key.

8. Legal guarantees

Regardless of the right of withdrawal, the buyer benefits from the legal guarantees set out below. To invoke them, the buyer writes to the seller at the address given in section 1. The box below is a translation of the notice required by French law (annex to article D. 211-3 of the French Consumer Code); the French text prevails.

The consumer has a period of two years from the supply of the digital content or digital service to obtain the implementation of the legal guarantee of conformity if a lack of conformity appears. During a period of one year from the date of supply, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.

The legal guarantee of conformity entails the obligation to supply all the updates necessary to keep the digital content or digital service in conformity.

The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following the request, free of charge and without significant inconvenience.

The consumer may obtain a price reduction while keeping the digital content or digital service, or may terminate the contract and be refunded in full in return for giving up the digital content or digital service, if:

1° The professional refuses to bring the digital content or digital service into conformity;
2° Bringing the digital content or digital service into conformity is unduly delayed;
3° The digital content or digital service cannot be brought into conformity without costs imposed on the consumer;
4° Bringing the digital content or digital service into conformity causes significant inconvenience to the consumer;
5° The lack of conformity of the digital content or digital service persists despite the professional's unsuccessful attempt to bring it into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to first request that the digital content or digital service be brought into conformity.

Where the lack of conformity is minor, the consumer is entitled to cancel the contract only if the contract does not provide for the payment of a price.

Any period during which the digital content or digital service is unavailable in order to be brought back into conformity suspends the remaining guarantee period until the digital content or digital service is supplied in conformity again.

The rights mentioned above result from the application of articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.

A professional who obstructs the implementation of the legal guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (article L. 242-18-1 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the digital content or digital service is kept, or to a full refund in return for giving up the digital content or digital service.

9. Use of the license

Visual Engine remains the property of its publisher: the purchase gives a right of use, not ownership of the software. It is forbidden to share, resell or publish the key, to circumvent the license protection or to redistribute the software. In the event of fraud — a shared key, software modified to circumvent the license, a payment wrongly disputed — the seller may suspend or revoke the license.

10. Liability

Visual Engine depends on X-Plane 12, published by a third party: an X-Plane update may make it incompatible for a time, which the seller works to keep short. The seller is not liable for damage that does not result directly from a failure on its part. Nothing in these terms deprives consumers of the rights granted to them by law.

11. Personal data

The account keeps the buyer's email address, password in hashed (unreadable) form, licenses, the name and a technical fingerprint of the activated PCs, the log of sign-ins and activations (with the IP address) and the purchase history; and, if the buyer sends them from the app, X-Plane logs. This data is used to supply the license, provide support and fight fraud; it is neither sold nor used for advertising. Payment is processed by Stripe, which receives the payment data. The data is hosted on an OVHcloud server located in Canada. It is kept for as long as the account exists, and accounting records for the period required by law. The buyer may ask to access, correct or erase this data by writing to the seller, and may complain to the French data protection authority (CNIL, cnil.fr) if they believe their rights are not respected.

12. Complaints and mediation

For any complaint, the buyer first writes to the seller (contact@interilesairva.fr), who replies as soon as possible.

If the disagreement persists, the consumer may use a consumer mediator free of charge (articles L. 612-1 et seq. of the French Consumer Code); on request, the seller provides the contact details of the mediator it belongs to.

13. Governing law

These terms are governed by French law. The French version prevails; this English version is a translation. Consumers residing in another country of the European Union keep the protection of the mandatory rules of their country. In the event of a dispute, the competent courts are those designated by law; consumers may in particular bring a case before the court of their place of residence.
